Part of my practice includes helped injured people recover damages from dog bites but that practice is becoming more and more difficult each day as several homeowner insurance companies are excluding coverage for dog bites.

Florida law if clear that if your dog bites someone you are held liable for damages caused by that bite regardless of where that bite takes place. Several years ago it was actually quite easy; we would file a claim against the homeowner’s home insurance policy. However the recent trend that several insurers have come to adapt is to exclude all dog bite claims or to exclude any claims of specific dogs such as Chows, Pit Bulls, Doberman Pinchers, and even Labrador Retrievers.

If the owner of the dog does not have homeowners insurance or if that insurance does not cover a dog bite the victim is left with only two options. The first option is to do nothing and absorb all of the costs and damages associated with the incident. Or secondly they can sue the dog’s owner for the damages. If the owner does not have any money or savings this can often be a waste of time and resources leaving the victim in even a worse spot. However, if the owner of the dog does have financial resources they may want to proceed with actions towards that person. After all why should the victim of a dog bite have to come out of pocket to pay their medical expenses from the act of someone that did not control their own pet? On top of that there could be permanent damage and future pain and suffering from that incident.
